Activist Judge Rejects Georgia LIFE Act

A judge in Fulton County overturned the Georgia LIFE Act, agreeing with abortion advocates who claimed the law was unconstitutional at the time of its enactment. Life Issues Institute is disappointed by this ruling but hopeful the law will be reinstated.

The Georgia LIFE Act prohibits abortion once the baby’s heartbeat is detected, around six weeks gestation. The 11th Circuit Court of Appeals allowed the law to go into effect in July, citing the Supreme Court ruling in Dobbs v. Jackson Women’s Health Organization.

In response to the latest ruling, Attorney General Chris Carr filed an appeal with the Georgia Appeals Court.

“Clearly this activist judge is doing the bidding of the abortion industry,” Bradley Mattes, president of Life Issues Institute, said. “The right to privacy Judge McBurney claims is in Georgia’s constitution addresses the issue of the government monitoring its citizens, not abortion.”

The errant judge is also doing an end run around the clear will of the people. During the 2022 midterm election, Georgians reelected Carr and Governor Brian Kemp, who signed the Georgia LIFE Act. The outcome of the election shows that Georgians embrace pro-life politicians and reject abortion on demand. They support laws that protect mothers and unborn children from abortion.
