Supreme Court Rejects Moyle v. United States

Life Issues Institute is disheartened by the Supreme Court’s ruling in Moyle v. United States allowing emergency rooms to function as abortion facilities.

Idaho contested that the Biden administration’s application of the Emergency Medical Treatment and Labor Act (EMALTA) would force emergency rooms to be “federal abortion enclaves governed not by state law, but by physician judgment, and enforced by the United States’ mandate to perform abortions on demand.” The government contests that hospitals must provide “necessary stabilizing treatment” which they interpret to include abortions.

The Court rejected the case not on the merits, but rather dismissed it as improvidently granted. As a result, the Court has reinstated a lower court’s pause on the Idaho pro-life law while litigation continues. We hope that when the lower court reaches a resolution to this issue, life will be protected.

Brad Mattes, President of Life Issues Institute stated, “We’re witnessing a Court that appears to be following the doctrine of Chief Justice John Roberts – kick the can down the street instead of making needed bold decisions. Looks like this philosophy is having an indelible impact on Justices Barrett and Kavanagh.”

Life Issues Institute stands with states that have courageously taken steps to protect the life of the unborn. We will continue to work with these states to ensure that the most innocent and vulnerable among us are protected, especially in emergency rooms.

Life Issues Institute is dedicated to changing hearts and minds of millions of people through pro-life education. Organizations and individuals around the world depend upon Life Issues Institute to provide the latest information and effective tools to protect innocent human life from fertilization to natural death.
