Supreme Court Rejects Moyle v. United States

Life Issues Institute is disheartened by the Supreme Court’s ruling in Moyle v. United States allowing emergency rooms to function as abortion facilities.

Idaho contested that the Biden administration’s application of the Emergency Medical Treatment and Labor Act (EMALTA) would force emergency rooms to be “federal abortion enclaves governed not by state law, but by physician judgment, and enforced by the United States’ mandate to perform abortions on demand.” The government contests that hospitals must provide “necessary stabilizing treatment” which they interpret to include abortions.

The Court rejected the case not on the merits, but rather dismissed it as improvidently granted. As a result, the Court has reinstated a lower court’s pause on the Idaho pro-life law while litigation continues. We hope that when the lower court reaches a resolution to this issue, life will be protected.
